1. GENERAL

1.1 These general terms and conditions (“Terms”) apply to orders placed by a consumer (“You” or “the Customer”) when shopping via Palmar Studio’s online store at www.palmarshop.com (“the Website”). When ordering from the Website, an agreement is entered into between the Customer and Palmar Studio AB (“Palmar”, “Palmarshop”, “Palmar Studio” or “we”). By using and ordering goods from the Website, you accept these Terms. As we may update or change these Terms in the future, we recommend that you regularly review the Terms so that you are aware of any changes. Palmar Studio reserves the right to change these Terms without notifying you in advance. The prevailing Terms will be available on the Website, and the Terms available on the Website at the time you place your order apply to that order. If the Terms change after you have placed your order, the terms that were published at the time of your order will apply throughout the entire purchase and return process.

1.2 You may not order on the Website if you are under 18 years old or under guardianship.

1.3 Please note that you can only order from the Website as a consumer, and thus you may not order on behalf of a company or business. If you wish to order as a business operator, please contact us using the contact details provided on the Website.

1.4 Palmar Studio reserves the right for sold-out items and possible image or typographical errors on the Website, such as errors in product descriptions or technical specifications, incorrect prices or price adjustments, or incorrect information that an item is in stock. We reserve the right to change the information on the Website at any time to correct any errors and to otherwise update or change the information provided on the Website. If you have ordered an item for which an incorrect price has been stated, we will notify you and await your approval of the corrected price before we continue processing your order. All image information on the Website should be viewed solely as illustrations, and it cannot be guaranteed that they accurately depict the exact appearance of the item in terms of, for example, color, fit, or features.

2. AGREEMENT AND ORDER

2.1 By placing an order on the Website, you make an offer to Palmar Studio to purchase the goods you have selected, based on these Terms. Palmar Studio reserves the right to accept or decline this offer. We recommend that you save the purchase confirmation you receive by email to facilitate any contact with our customer service.

2.2 Before completing your order, you will have the opportunity to review it to notice any inaccuracies. We urge you to review your order carefully before proceeding. If you discover errors in your order after you have completed it, we urge you to contact our customer service as soon as possible using the contact details provided on the Website. Please note that your order cannot be canceled once it has been confirmed. If you no longer wish to stand by the purchase, you must wait for the delivery of the products and use your right of withdrawal as per section 5 below.

3. PRICE AND PAYMENT

3.1 When ordering from the Website, the prices stated on the Website at any given time apply (subject to errors in accordance with section 1.4 above). Prices are stated in Swedish kronor and include VAT. We reserve the right to change the prices stated on the Website at any time. Naturally, such changes do not apply to orders that were already confirmed when the change was made.

3.2 Palmar Studio may from time to time offer promotions on the Website that may have more favorable terms than those stated in these Terms. These terms apply for as long as the promotion is active and for the specific goods covered by the promotion, as stated about the campaign on the Website. Palmar Studio reserves the right to change or discontinue such promotions at any time.

3.3 Payment is accepted in accordance with the payment options stated on the Website at any given time. Palmar Studio has the right to charge at the time of the order, unless otherwise indicated by the chosen payment method. Note that any restrictions for the different payment options, where applicable, are stated in the information on the Website. Palmar Studio reserves the right not to provide all payment methods at all times.

3.4 Palmar Studio reserves the right to assign or pledge payment claims, including installments, arising from the purchase of goods in the online store to a third party.

4. DELIVERY AND SHIPPING

4.1 Currently, goods purchased on the Website are only delivered to addresses located in Sweden. The delivery terms stated in these Terms apply to deliveries within Sweden.

4.2 Shipping to Sweden costs 69 SEK, unless otherwise stated on the Website when placing your order.

4.3 Delivery normally takes place within 1-5 business days from the confirmation of the order if the ordered item is in stock. However, Palmar Studio cannot provide any guarantee regarding delivery time, e.g., because the delivery time may depend on factors over which Palmar Studio has no control or could not have foreseen. If you have not received your item within 7 business days after you received notice that your item has been shipped, we recommend you contact our customer service for further information and assistance.

4.4 If the item is delivered as a package, you should pick up the package within the time specified in the notification, which is usually 14 days. Notification can be via mail, email, SMS, or by phone. Normally, packages should be picked up personally by the Customer. Order number or notification number may be required, along with valid photo identification by you as the Customer. If you do not pick up your package within the time specified in the notification, we reserve the right to charge you 200 SEK in administrative fees.

4.5 If your order consists of multiple items, we reserve the right to deliver the order in several separate deliveries. For example, we may need to do this if the ordered items need to be delivered in packages of different sizes.

4.6 Please note that after you have received your delivery, you bear the risk for the goods. Once you have received your items, you should inspect them as soon as possible, and if you discover something is wrong or damaged, contact our customer service immediately using the contact details provided on the Website.

5. RIGHT OF WITHDRAWAL AND RETURNS

5.1 For all orders on the Website, a 14-day right of withdrawal applies in accordance with applicable legislation. This means that within 14 days from the day you, or someone you designated to receive the goods on your behalf, received the ordered item, you have the right to cancel the purchase by informing Palmar Studio.

5.2 The right of withdrawal does not apply to goods that have been manufactured according to your instructions or otherwise provided with a distinct personal touch, nor to goods with a broken seal that cannot be returned for health or hygiene reasons (e.g. underwear and accessories).

5.3 If you wish to cancel your purchase, you must inform Palmar Studio using the return shipping label and the return form that came with your order. If you no longer have these when you wish to cancel your purchase, we urge you to contact our customer service using the contact details provided on the Website, and we will send you a new set of return documents. You can also use the standard form for exercising the right of withdrawal provided by the Consumer Agency, available for download at www.konsumentverket.se, and then send the completed form to Palmar Studio by mail or email to the addresses listed on the Website. Please contact our customer service if you have any questions.

5.4 When exercising the right of withdrawal, you are responsible for the condition of the goods from the time you received the item until Palmar Studio receives the returned item. The item should be returned within 14 days from the day you informed Palmar Studio that you exercised your right of withdrawal for the purchase, in accordance with the return instructions included with the ordered items.

5.5 When exercising the right of withdrawal, Palmar Studio will refund the amount you paid for the item. Palmar Studio has the right to deduct an amount corresponding to any depreciation that may have occurred because you have handled the item more than necessary to determine the item’s properties and function (e.g., if the item has been used, damaged, washed, altered, or if tags and labels have been removed). Refunds are normally made within 14 days from the receipt of the notice of withdrawal. However, Palmar Studio reserves the right to withhold the refund until the returned item is received, or until the Customer provides evidence that the item has been returned. The refund will typically be made using the same payment method chosen by the Customer at the time of purchase, provided that the refund can be made using the same method and unless otherwise agreed upon in the specific case.

5.6 If the item you received is defective or damaged, as considered an error under the applicable consumer protection legislation at any given time, you have the right to claim a defect, provided you inform Palmar Studio of the defect within a reasonable time. This means you must contact Palmar Studio as soon as possible after discovering the defect. If you notify Palmar Studio within 2 months of discovering the defect, the complaint is always considered timely. The right to complain remains up to 3 years after the purchase.

6. HOW YOUR PERSONAL DATA IS STORED

The personal data we collect is stored within the EU/EEA by us and by appointed data processors, such as our IT service providers, and will not be transferred or processed in any country outside the EU/EEA.
